General Terms & Conditions

The following General Terms & Conditions include legal information regarding your rights according to the Distance Selling Act and E-Commerce

§1 AREA OF VALIDITY
These general terms and conditions are applicable to all deliveries carried out by damalogic, Marcus R. Odrowski (Online-Shop www.sinum-italia.com) to consumers (§13 BGB)

§2 CONTRACTUAL PARTNERS
The contract of sale comes into being with damalogic, Marcus R. Odrowski, Mozartstrasse 10, 84577 Tuessling. §3 OFFER AND CONCLUSION OF A CONTRACT
§3.1 The representation of the products in the online shop does not represent a legally binding offer, but is a non-binding online catalogue.
After inputting your personal data and by clicking the button ‘Send’ in the final step of the order process, you are submitting a binding order of the goods contained in the shopping cart.
§3.2 The confirmation of our receipt of your order follows immediately upon sending the order. The sales contract becomes effective with receipt of our order confirmation or delivery of the goods. If you do not receive an order confirmation or the delivery within two (2) weeks, you are legally no longer bound to your purchase.

§4 REVOCATION (only valid for members of the European Union)
§4.1 Right of withdrawal: You may withdraw your contract without giving reasons within two weeks in writing (e.g. letter, fax, email) or  - if  the goods have been sent to you before the end of this period - by returning the goods.
The period begins upon receipt of this notification in writing, but not before receipt of the goods by the consignee (for recurring consignment of similar goods not before receipt of the first part-delivery) and not before fulfilling our information requirements due to article 312c section 2 BGB in conjunction with article 1, section 1, 2 and 4 BGB-InfoV and not before fulfilling our obligations due to article 312e sentence 1 BGB in connection with article 3 BGB-InfoV. In order to meet the revocation deadline it is sufficient to dispatch the revocation or goods in time.

§4.2 Consequences of revocation: In the event of effective revocation, the services received by either party shall be returned and any benefits that may have been accrued shall be released. Should you not be able to return the received benefits completely or only in part or in a worsened condition, compensation must be made for the lost value. This does not apply if such deterioration is entirely attributable to their inspection as it would have been possible for you e.g. in a retail shop. However, you can avoid the obligation to compensate for deterioration in quality caused by usage, by not using the articles as your property and refraining from all actions that may affect their value. Items suitable for delivery by parcel are to be returned at our risk. You have to bear the cost of returning if the goods ordered are in conformity with those ordered, and if the price of the items returned does not exceed an amount of 40 Euros or if in the case of a higher price of the goods you have not yet performed the service in return or any partial payment as agreed upon by contract at the point in time of revocation. Otherwise, the return shall be free of charge for you.
Items not suitable for shipment will be picked up. Obligations to refund payments must be met within 30 days. For you, the period begins upon dispatch of your statement of revocation or of the goods, for us, upon reception thereof.

§4.3 Please avoid damaging and contamination. If possible, please send the product in its original packaging with all accessories and all parts of the package. If necessary, please use a secondary packaging. Should you no longer have the original packaging, please choose a suitable packaging to avoid claims for damages caused by defective packaging.
§4.4 Please send the goods as an insured package and keep the mailing receipt.
§4.5 Before reshipment please contact us by phone at +49 (0)89 7456 7997 to announce the return consignment.

§5 PRICES AND SHIPPING COSTS
§5.1 All prices stated at the product sides contain the valid legal value added tax as well as all other price components.
§5.2 In addition to the quoted prices, we charge 129,00 € per order for shipping within Germany and to Austria.

§6 DELIVERY CONDITIONS AND SELF-DELIVERY RESERVATION
§6.1 Delivery is done within Germany and to Austria by a forwarding agency free to kerbside
§6.2 Normal delivery time within Germany and to Austria is 3-4 weeks, if not specified otherwise.
§6.3 Should products you have ordered be out of stock, we are entitled to make partial deliveries at our costs, in so far as this is reasonable for you.
§6.4 After three unsuccessful delivery attempts we shall have the right to withdraw from the contract. Should payments have been effected, these will be returned by us.
§6.5 If the ordered product is not available, because we are not to be supplied from our supplier without our own fault, we can cancel the contract. In this case, we will inform you immediately, and, if required, suggest the supply of a similar product. If there is no comparable product available, or you do not want, that we supply a comparable product, we will, if necessary, refund services already rendered forthwith.

§7 PAYMENT METHODS
§7.1 Payment may be made by Prepayment via bank transfer, by PayPal or by the service provider SOFORTÜBERWEISUNG
§7.2 If you choose payment in advance as method of payment, we will send you our bank details in the order confirmation email. The invoice amount is payable within 10 days to our account.
§7.3 In case of default of payment, interest at the rate of 5% above the base rate is charged, without prejudice to any assertion of claims for damages.
§7.4 The customer shall only be entitled to a right of set-off provided that his counter claims have been judicially determined, or are uncontested or acknowledged by us.
§7.5 The customer may only assert his right of retention insofar as it is based on the same contractual relationship.

§8 RETENTION OF TITLE
We reserve the title to the goods until full payment is made.

§9 WARRANTY
The warranty takes place according to legal regulations. For all defects that occur during the two year legal period of warranty you are entitled to supplementary performance (either removal of defects or replacement) as well as to mitigation, withdrawal or compensation if all legal stipulations are met.

§10 FINAL PROVISIONS
§10.1 If any provisions of these general terms and conditions are or become invalid or unenforceable, this will not effect the validity of the other provisions.
§10.2 German law applies.

If you want to buy the products in the shopping cart, click the Order button. In this case please type in your data. Mandatory fields are marked with an asterisk (*). Registration is not required. Transmission will be encrypted. After entering your data and choosing your preferred method of payment you can continue to the order page by clicking on the button [Continue Order], on which you can check your data again for errors.
By clicking on the button [Send Order] you complete the ordering process.
The process can be cancelled at all times by closing the browser window.
On the single pages you will be informed e.g. about possible adjustments.

Text of the contract:
The contractual text is saved within our internal system. The General Terms & Conditions can be consulted on this page anytime. The order data as well as the General Terms & Conditions will be sent to you by eMail. By reason of security the contractual text will not be accessible anymore after finishing the order process.
